A national study conducted by the Bhartiya Muslim Mahila Andolan (BMMA) concluded its report by giving some horrifying figures that roughly 1 out of every 11 Muslim women have gone through or have survived the trauma of triple talaq. Critiques have termed this as an ‘abhorrent practice’ which should be revoked and should be done with by the Supreme Court. Instances of torturing and the trauma women have to go through have been reported in the past. Arshiya Bhagwan, an 18-year-old girl alleged after surviving lot of torture from her husband she went to stay with her parents and received a letter with the word ‘talaq’ written thrice, which she refused to accept.
AIMPLB
The All India Muslim Personal Law Board (AIMPLB) which makes strategies to protect Muslim personal law has countered and tried to justify the triple talaq system and given its arguments in favor of the system. AIMPLB stated that this system provides “protection to women” as women are a “weaker sex” and they need “men for their protection.” The Board also stated that women “get killed” if men don’t get an “easy divorce” or women are “burned alive.” The justification also states that getting divorce from a court “scandalises a women’s image.” The board also stated that “men have a greater reasoning power than women.” The board also argued that polygamy is a “social need” and a “blessing.”
Supreme Court On The Issue
The Chief Justice of India T S Thakur stated, “This is a very important issue. It affects a very large section of the population.” The SC also stated that the issue will be tested on the ‘touchstone of the Constitution.’ The apex body also granted the government to file its reply on the topic. The Supreme Court would also refer to a larger bench if need arises.
Government On Triple Talaq
The incumbent government has totally opposed the system of triple talaq in the Supreme Court. The government stated that no compromise and no justification can work when it comes to gender equality and dignity of women. Islamic clerics of Agra have been outspoken on the issue and they have said that they will not let the incumbent government interfere with Islamic laws. It was even called an “attack on basic tenets of Islam.
