At 23rd Dec,Delhi,a horrific incident of a brutal rape of a 23 yr old woman had shook the whole nation.peoples got outraged,protest had came out from every single corner of the country.Social media was flooded with related news.Question arised over the administration and on the govt. as well.One political party i.e. bjp hold the protest for 3 months but after sometime,we’ve gone ‘normal’.This incident became ‘the electoral issue’ along with some others at the LS poll time on 2014.And we peoplehad floated ourselves with the ‘promise of ache-din’,’vikas & modi-magic’.
Ironically,the incident of Rape,Molestation,Stalking & other crime has been increasing since 2014 rather than neutralized.Again the question arising on the govt.,administration by ‘very few amount of people’ and surprisingly, abundant no. of people are trying to ‘communalize everything’ even ‘much sensitive issues like Rape’. And people like me are showing their outrage only in social media.
I’d never thought about to written on it ,maybe the ‘regular news of sexual harassment & crime’ had let me ‘immune’ on these issues too like others.But “the vibrant innocent smily face” of “the 8yr old girl Asifa” who’ve victimized of gangrape & murder by some “ghoulish,distorted,sick-souled,relentless flaws of society” in Kathua,J&K,have compeled me to express the agitation over sexual crime in writing.
When I was hearing the news on TV and seeing her face simultaneously,I’ve found the ‘Father’ inside me.The anxiety cited on my mind that when I would be father then my child could be landed on ‘more brutal world’ than now. The situation led me into this perception, because,when the Pan INDIA protest happening for ‘Justice for Asifa’ & ‘Justice for Unnao(where a 17yr old girl had been gangraped by bjp MLA and his associates)’,two another heart-wrenching horrifying inhumanic incident happened in Surat,Gujrat and other in Etah,UP.In Surat,an 11yr old girl was ‘tormanted with 80 scars of torture’ and then killed.In Etah,an 8yr old abducted from an wedding then ‘raped & murdered’.These same barbaric procedure has been conducted with Asifa in Kathua,only the culprit and places are different.
Oh!! God!!! How anyone can do that??!! How anybody could be so ‘diabolical’,’sick-souled’,’ghoulish’,’inhumane’??!!! How can anyone think about to do ‘that kind of heinous act’?? Don’t they’ve any women in their home??!!! If ‘yes’ then there is a question that “how they visualize their mother,daughter,sister???!!!” And the answer is “they see their kin-women and any women in the world as “women-meat” which could be enjoyed sexually with heinous activity”.
This quoted line is so rude to read but that is true.Because, after Asifa’s & Unnao gangrape case,many rape and rape-murder case has been occurred, especially in Bihar’s Champaran district,where a ‘father’ seually exploited his 13yr old girl and for that the girl commited suicide by hunging herself.And in Gujrat’s Patan town, where a 46yr old ‘mother’ was raped by her 22yr old ‘porn addict son’.And other happened before like this incident(mentioning the Bihar’s incident not the Guj’s) which have forced me to write that ‘harsh line’.
Some people could balme on the ‘porn-industry’&’movie’s item dances’ but the incidents of rape has been happening since the time of ‘dhananand’.Sexual Crime mainly conducted by the ‘ghoulish-mind’ of miscreants,porn & item-dances can partially instigate someone to do so(only my perception).
Surprisingly & Ironically,that political party i.e. bjp who had held protest for 3 months for ‘Nirvaya-Incident’,2 of their J&K minister were present on the rally by ‘hindu-ekta manch’ for “support of the accused” by “waving Tiranga flag”.And some ‘so-called lawyers’ had barred the police to filled the chargesheet to court and holds a “Jammu bandh” on the behalf of those rapist along with that fringe group.
And in Unnao,the MLA of bjp,the current ruling party in UP,was the main accused & the victim’s father killed in the police custody at the time of complain about the incident.Another MLA of bjp have said that “no-one can rape a mother of 3”.Then please tell me why the Christian nun of WB’s Ranaghat had been raped at her 70s??!!.Is this the “Beti-Bachao”,”Ram-Rajya”,”Achhe-Din” & “Nationalism” of bjp,the present central’s rulling party.
When INDIA was outraged(or still outraging now too) on Kathua & Unnao gangrape case where central’s ruling party personnel & cops are involved,I’ve started a petition which says”Amendment on the law with’Death-Sentence to Rapist’(Even for juvenile accused too)”.Some ‘so-called’’human-right activist’ will say “it would be ‘inhumanic’ to ‘hung the rapist’ and ‘juvenile accused’,they must be entertained a 2nd chance”.
So the increasing ‘rape-culture’ is ‘humanic’???!!! Is there no value of the ‘excruciation’,’tormentation’,’mental-trauma’ of the victim???!!! Then anyone could colclude that there is a ‘hidden-rapist’ inside those human right activist,otherwise who’ll talk on the be-half of rapist?? Rather than having the solidarity to the victim.Harshnes is that, some ‘intelectual person’ now making a ‘film’ over the “innocence of a rapist name dhananjay”,who was heard the ‘death-sentence’ for being a rapist of a minor girl in WB at 2006 approx.Ministers are taking part on the march for rapist’s behalf,Tiranga is now using to cover the blood-soars of the “most-inhumane maniac criminals” of the society.
And which is called ‘Juvenile’?! A ‘preset no. of age’ or the ‘innocent activity of mankind use to carry on at a particular time of life’???[Yes,it is true that nowadays kids at the age of 12-13 are awaring about sex,lust,intercourse even we all have known this prematurely but we did n’t think about to commit ‘rape’.That depends on the “education(which has been defined by SWAMI VIVEKANANDA)” & the ‘domestic atmosphere’] So, tell me, does that ‘activity’,which was done at the time of ‘Nirvaya-Incident’ by a ‘so-called minor’ or recently happened ‘Kathua-Incident’ where one of the accused is ‘minor’, lies into ‘Juvenile Catagoery??’
Whenever, a person have the perpetratory mentality to accomplish such ‘ghoulishly diabolical act’,should n’t be barred from treated as a ‘notorious antisocial criminal’.In Haryana’s Gurugram, a ‘class VII students’ sent a ‘rape threat email’ to his teacher and her daughter and at the same school, a ‘class VIII student’ ‘proposed to teacher with a ‘candle light dinner and sex’ via e mail’.In Delhi, 5 ‘minor’ had raped a woman of her mid 20s when returning home from workplace.These predatory acts could be called as ‘juvenile??’ When a 12-13yrs old kids lost his innocence,when they are aware very well about ‘the aftermath’ which would n’t be ‘menace’ to them ‘so much’ if they’ll do that.Because the law have made them ‘this kind of able’, because they will be ‘forgiven’ just being for under 18 and will be sentenced to be in ‘correctional home’.If the amendment would occurred with the ‘Death-punishment’ for rapist,even for juvenile convict,then there would be a huge chances of ‘decreasing’ or ‘not happening’ of sexual crimes.
Now, after multiple ‘henious rape cases’ against minor from every corner of India,the central govt. have passed the amendment which says “Accused of rape of minor below 12 will get the punishment of ‘Hung to death’ as the ‘most-stringent’ and ‘life-imprisonment’ as the less[though it could prevent the ‘ghoulish-perpetrators’ but influential convict could make themselves free from being hung and how they lives in jail,everyone knows that]”.
Before the central, 1st the MP then Rajasthan govt. have passed this law.Yes, this is praisable and it’s needed very much otherwise we could see more ‘Asifa’,[even a 4 month old in Raipur was raped & murderd and an 8mth old raped in Delhi].But the rape of adult-victims is not an offence to be guilty with ‘death-punishment’?? Why and which parameter is barring the law-makers to do that??
I don’t know anything about the IPC codes & the process of judiciary.I know only few thing that, we live in a democratic-country where common people’s word is the ‘last word’.Now every common people want most stringent punishment for rapist with wheather ‘Hung to death’ or ‘more than that’. So, what stopping the judiciary to bring this amendment??!!
I belive that, if Dr. B.R.Ambedkar would present now,then he would definitely bring this amendment as we the commoners want.He has made the “most beautiful constitution” in the world by taking the ‘best constitutions’ from different nations.That’s why he would surely collect the ‘most stringent laws for rapist’ from discreet countries.
Finally, we the people of India want amendments on the law should be that-
- Accused first be detained by cops at the time of FIR.
- The process of enquiry should not be delayed, must be completed within 1.5 to 2 months,should n’t be influenced.
- If the accused found as guilty then he/she/others should be hung to death or more, no juvenile excuse would be entertained.
- Make the amendment that stalking, molestation and all other sexual harassment cases as non-bailable offense and the accused if proven guilty then they’ll be sentenced to behind the bar for upto 10yrs and the enquiry should be finished within 1 mth.
- Protocolwise multiple SIT should be formed to supervise the enquiry procedure of police where the FIR first registered as well the working procedure of SIT stratifications.
- If any enquiry or other crime branch, police related personnel try to tamper the evidence, they should be taken into custody and their job would be dismissed and further they won’t be able to apply for any govt. non-govt. jobs, 5yr jail is needed for them.
- Preventation of filling chargesheet should be taken account as a cognizable offense and maximum 10 yrs of imprisionment is required.
- If any rally for rape-accused will be organized, then everyone related to this rally should be booked and related and will be sentenced to jail for 14yrs.
- If any case would be found as false, only formed for seeking vengeance, then the complainant should be hung to death.
But when these amendment would be made, until ‘all of us’ will be ‘victimized’ of ‘sexual-crimes’???!!!
