Changing Society’s Mentality Towards LGBTQ Community Will Be A Tough Battle

The Supreme Court in a historic judgment decriminalised Section 377 and upheld the constitutional legality of homosexuality. With this judgment, people, especially the LGBTQ community, got second Azadi (freedom) from the Victorian-era law.  The people of the LGBTQ community are also part of the society, and homosexuality is as natural as Sun being round. We have progressed a lot and have reached Mars. Hence, there was no need of continuing with archaic 1861 the colonial law.

The five-judge constitutional bench successfully removed few provisions from Section 377 and noted that Right to privacy is a fundamental right. In India, everyone has the right to Equality. The society needs to change its thinking. We will have to leave our old thought process.

Being in the majority doesn’t give the right to what’s natural and what’s not. Chief Justice Dipak Misra along with justice R.F.Nariman, justice A M Khanwilkar, justice D.Y. Chandrachud, and justice Indu Malhotra reserved their judgement on July 17. The verdict was put out on September 6. According to the judgment, the right to live is a human right without which laws won’t stand any ground.

The court has done the job, and now it’s our duty to follow what the court had said. Now, the real fight will begin as changing mentality is the toughest job.
