Chronology of CAA, NRC and NPR

India faced migration and illegal immigrants problems since it’s independence. As in 1947, when India got independence many people migrated in India from neighbouring countries such as Iran, Pakistan and Afghanistan and to reduce these migration problems the government of India brought up with a citizenship act 1955 in which it was clearly stated that India will grant citizenship to those who migrated in India before 1948. Since India adopted the ideology of secularism in 1976 India became the shelter of many refugees from India’s neighbouring countries. Again in 1971 when Bangladesh was struggling for its independence many Bangla community migrated in India’s North eastern part and by this Assam Student Union came forward and protested against the illegal immigrants in India’s North eastern part. It was a first time when the word “illegal Immigrants” Emerged. Then the Atal Bihari Vajpaye government in 2003 amend the new law in citizenship act 1955. Now, in 2014 when a large number of small community Rohingya muslims flee India from Myanmar and this causes a major problem to India.

By this the center government bring up a law citizenship amendment Bill 2019 with new provisions which lead a mass protest in India. As it add some new words:- refugees, illegal immigrants and persecution. But it also stated that India will welcome only non Muslims communities such as hindu, sikh, parsi, Christians, Buddhist, jainism communities from Pakistan, Afghanistan and Bangladesh. And this new law passed by the Lok Sabha on 12 December 2019 lead a huge mass protest in most parts of India.

In my opinion firstly, CAA is unconstitutional as it abolished secularism and violate article 14 which is right to equality and protection. Secondly, it violate the Assam Accord as it is clearly stated that the communities of non Muslims who migrated in India before 31 December 2014 will grant Indian citizenship and as per the NRC which was recently held in Assam it excluded 20 lakh people and mostly they were hindu bengali and with the help of this new law they will able to attain the Indian Citizenship which can harm their cultural identity. Thirdly, the Modi-Shah government is being Hippocratic as their ( Narendra Modi and Amit Shah) statements are contradicting each other. As now they are claiming that they never discussed the NRC in lok sabha but earlier Amit Shah the home minister of India clearly stated that NRC will implement not only in North eastern parts of India but all over in India. Now they are implementing NPR which will help to bring NRC in India. Fourthly, it has no transparency and has many loopholes which was clearly seen in Assam NRC where many people had to face many problems by NRC. Fifthly, the persecuted communities such as Rohingya, Ahmadiyya and the Shia muslims are not included in Citizenship amendment Act 2019 which means this law is on the basis of religious ground. Sixthly, By bringing up this law the NDA government is diverting such major issues in India such as women safety, unemployment, decline of economic, poverty and the rising prices of goods.
